(“Buyertise“, “we" “us" or “our“), we are committed to protecting the privacy of all individuals (the “User“, “you" or “your“) who use our Website relating to a business for sale marketplace and related communication services, sites, applications and tools (collectively, the “Service“) that is owned, operated, or powered by Buyertise. Through use of the Service, Users provide us with their information, including personally identifiable information (“Personal Information“). This Privacy Policy is written to help you understand how your Personal Information is collected, used, stored, and disclosed when you use the Website and the Service.

This Privacy Policy should be read in conjunction with our Terms and Conditions of Use. All defined terms not otherwise defined have the meaning given to them in the Terms and Conditions of Use.  Please make sure you read and understand both the Terms and Conditions of Use and the Privacy Policy before registering on our Website or otherwise making use of the Website and the Service.

BY USING THE WEBSITE AND THE SERVICE, YOU CONSENT TO THE COLLECTION, USE AND DISCLOSURE OF YOUR PERSONAL INFORMATION AS EXPLAINED IN THIS PRIVACY POLICY.

You are under no obligation to provide Personal Information, with the caveat that your refusal to do so may prevent you from using certain portions of our Service. Buyertise does not collect, use, store or disclose Personal Information without your consent, except as required by Law or as set out below.

If you have any objections to the terms in this Privacy Policy, you should not use our Service or provide us with any of your Personal Information, as by providing your Personal Information to us you are deemed to have consented to the processing of such data. 1. PERSONAL INFORMATION COLLECTED

  1. Information You Provide
    1. Identity Data. We collect the Personal information that you provide to us, which may include, but is not limited to:
      1. Basic Personal Information, including your first and last name, date of birth, and contact information;
      2.  Information required to utilize the Service, including, but not limited to communications made through the Website, business background information, photographs, business addresses, broker qualifications, and any other data included in your Listings;
      3. Information about your use of the Service and any saved User preferences on the Website; and
      4. Analytical information, including, but not limited to, your login data, browser type and version, time zone settling and location, browser plug-in and versions, operating system and platform and other technology on the devices you use to access the Website.
    2. Account Information. When you register as a User on the Website to gain full access to the Service, you will need to provide us with Credentials, including but not limited to an email address, username and password;
    3. Financial Information. Information including but not limited to bank account or credit card numbers; and
    4. Marketing and Communications Data. We record your general communication preferences as described below. We also record your preferences as to how you receive marketing communications from us and from third parties as described below.
  2. Automatic Information Collection
    1. The Website automatically collects information and may use this information to customize your visit. The information automatically collected includes, but is not limited to, the following:
      1. General Usage Data: When you use the Website, we may collect technical properties of hardware and software utilized in conjunction with the Service. For example, we may collect the type and model of hardware and/or web browser you are using, referring or exit web pages, and the operating system version you are using. When you use the Website we may also collect information about your location (as described below under the heading “Location Data"), how long you use our Service for in each session, features you use in our Service, and the actions you take while using our Service.
      2. Cookies: Cookies are small data files that are placed on your computer’s harddrive by computers (or servers) to identify your computer.
      3. Web Beacons: Web beacons (also known as pixel tags, Internet tags, clear GIFs, or single-pixel GIFs) are electronic images embedded into a web page which generate generic notices of visit when the page is accessed.
      4. Location Data: We also log Internet Protocol (IP) addresses – the location of your computer on the Internet. We do not store this information in a personally identifiable form.
  3. Data Collection by Third Parties
    1. Our distribution partners and other third party vendors may collect information about you when using the Website through the use of cookies and web beacons. For example, third party advertising companies, use cookies and Web beacons to serve advertisements about goods and services that may be of interest to you across the Internet based on your past visits to the Website and other websites.
    2. Buyertise may also use third party vendors to collect statistical information regarding usage of the Website for the purpose of managing and targeting advertisements on the Website, and/or on other websites.
    3. Buyertise uses third party vendors for the processing and payment of use of the Service, the terms of which, including any privacy policy related thereto shall be solely those of such third party vendor.  Buyertise assumes no responsibility, liability or, risk with respect to the provision of those third party vendor payments services. By using the Service you agree to use such services, at your own risk.

2. USE OF PERSONAL INFORMATION

  1. Personal Information Use:  Personal Information is used by Buyertise in the followings ways:
    1. to verify your identity and, if applicable, broker qualifications;
    2. To confirm or fulfill a request that you make through use of the Website and the Service;
    3. To communicate with you regarding your Account and the Service (e.g., the Website may send you confirmation emails or Listing alerts);
    4. To send you promotional materials, newsletters, or other content via email, targeted advertising, or otherwise, unless you have indicated that you do not wish to receive such materials;
    5. To maintain a member directory. The Website, by default, maintains a list of all members in a publicly accessible member directory. You may opt out of this directory at any time through the control panel section of your account or by contacting us at 4INFO@buyertise.com;
    6. To review and improve your user experience with the Website and the Service;
    7. For the Website’s administration, analysis, research, development, optimization and other internal purposes, including, without limitation, to compile general usage data;
    8. To allow for business continuity and disaster recovery operations;
    9. To detect, monitor,  investigate, mitigate or attempt to prevent fraud and technical or security breaches or to protect our property;
    10. To meet legal and regulatory requirements and to respond to emergency situations, for example, to respond to court orders, warrants or other lawful requests or legal processes; to provide emergency assistance in situations that may threaten the life or physical safety of you or others; or for any other purposes for which you have consented, or other purposes as permitted or required by any applicable law;
    11. To enforce our Terms and other legal rights;
    12. General Usage Date is used by the Website for administrative, analytical, research, optimization and other purposes. For example, the Website may use statistical analyses of Usage Data in order to measure interest in the various areas of the Website, for development purposes and to inform advertisers and partners in aggregate and anonymous terms about users who click on their advertising or other messages. IP Addresses are also used for systems administration and troubleshooting purposes;
    13. Cookies allow us to recognize you when you visit the Website, to personalize your experience and generally to serve you better. For example, if you enter your name, address or postal code on one of the Website’s forms, it may be stored in a cookie so you do not have to enter it again on other forms on the Website;
    14. Web Beacons (which may be placed by us or a third party tracking utility partner) are used to tell what advertising you have seen on the Website, in turn allowing us to offer you a more diverse selection of relevant advertising information and may also be used in conjunction with Cookies to measure the effectiveness of our advertising campaigns. Web beacons may also be included in emails sent by Buyertise to determine when and if such emails are opened or forwarded;
    15. Location Data is combined Cookies and Web Beacons to compile data regarding Website usage (what parts of the country are using the Website, what website you came from, what pages of the Website you visit, how long you were on the Website, what type of browser you are using, what website did you go to, etc.). This type of tracking does not identify you personally; and
    16. And for any additional purpose as may be necessary to maintain the function of the Website and the Service.
  2. Personal Information Sharing: Personal Information is shared by Buyertise in the following ways:
    1. Employees: Buyertise may share your Personal Information with such employees, contractors, consultants, affiliates and other such parties who require this information to assist us in developing, operating, and maintaining the Website and the Service.
    2. Distribution Partners: Buyertise may share your Personal information with its distribution partners, brokers, franchisors and other third parties on the condition that such partner’s disclosure and use of the information is consistent with this Privacy Policy.
    3. Service Providers: Buyertise may engage third parties to provide services on its behalf. Examples include providers of analytical, development, promotional, research, review moderation, and other services. For example, the Website may ask that a third party conduct an online survey, or send newsletters on its behalf. In such cases, Buyertise requires that the third party maintain the confidentiality of your Personal Information and use your Personal Information only to perform the specific engaged services and not for their own purposes.
    4. Third Party Advertising: Buyertise may share statistical and behavioral usage data about visitors to the Website with the third party advertising companies, like Google, for the purpose of managing and targeting advertisements on the Website and/or on other websites.
    5. Direct Marketing. Except as provided herein, it is Buyertise’s policy to not disclose the Personal Information of our customers to third parties for direct marketing purposes. If you are eighteen (18) years of age or older and have affirmatively agreed to receive third party direct marketing materials, the Website may share your personally identifiable information with third parties for direct marketing purposes. The subsequent use or disclosure of User Personal Information is subject to those third parties’ privacy policies and practices.
    6. Other. Buyertise expressly reserves the right to release any information provided by you, including Personal Information, to third parties under the following circumstances:
      1.  When required by legal or regulatory process;
      2. To investigate and/or take action against illegal activity, suspected abuse, or unauthorized use of the Website or Service;
      3. To protect the property or safety of our Users or others;
      4. To enforce our Terms and Conditions of Use; or
      5. In connection with any sale or other transfer of ownership of all or a part of Buyertise or any related businesses.
    7. If you make any Personal Information publicly available on the Website (e.g., by posting a public Listing), anyone may see and use such information. Buyertise makes no guarantees as to the privacy of such information and is not responsible for such use.
  3. Other Use of Personal Information by Third Parties
    1. This Privacy Policy does not describe the collection, use and disclosure of information through means other than the Website (e.g., another website, offline) or the collection, use and disclosure practices of any third party. For information on a third party’s information collection, use and disclosure practices, please review the privacy policy on the applicable third party’s website.
    2. You recognize that through your use of the Website and the Service, or as a result of disclosure to third parties as outlined above, or as a consequence of the network connections used to connect to the Website or any related servers or computer networks, any data transmitted may be transmitted to jurisdictions outside of Canada, and may therefore be subject to the laws of those other jurisdictions, which may differ from the laws of Canada.

3. SECURITY AND RETENTION

  1. Buyertise takes reasonable precautions to secure personal information within both its computers and its physical premises. We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage is 100% secure. Therefore, while we strive to protect your Personal Information, we cannot guarantee its absolute security. The Company will not be held liable in the event of unauthorized access to or inadvertent disclosure of personally identifiable information.
  2. We only retain Personal Information for as long as is necessary for the purpose for which it was collected. When we no longer are required to retain the information, we will destroy, erase, or de-identify the information. Legal requirements, however, may require us to retain some or all of the Personal Information we hold for a period of time that is longer than that for which we might otherwise hold.

4. EMAIL COMMUNICATIONS AND SPAM

  1. All registered Users who have consented to receive marketing communications will receive such communications via email from time to time. You may unsubscribe from receiving marketing communications at any time by updating your account settings.
  2. There are certain core email communications which are crucial to the functioning of your account. You may not opt out of receiving these core email communications. You agree that Buyertise may send to you, and you cannot opt out of, communications of a transactional or relationship nature, including, but not limited to, communications regarding fraudulent or illegal activity, account status, changes to this Privacy Policy or Terms and Conditions of Use, and communications to confirm and follow up on your registration and/or requests submitted through the Website.

5. USER ACCESS, CORRECTION AND CONSENT

  1. By using the Website or Service, you consent to the collection, use and disclosure of your Personal Information as outlined in this Privacy Policy.
  2. You may ask to see the Personal Information that we hold about you at any time. If you want to review, verify or correct your Personal Information, please contact 4INFO@buyertise.com via email. Please allow up to 30 business days for a response. We will require appropriate identification to our satisfaction and will require recovery of costs in providing information where reasonable and allowed by law.
  3. If your Personal Information happens to change during the course of our relationship, please keep us informed of such changes. You may update your Personal Information through the control panel section of your account.
  4. You may, at any time, modify or withdraw your consent by:
    1.  Adjusting your account settings through the control panel section of your account; or
    2. Your account can be deleted in the control panel. Your account information will be maintained for 30 days after the initial deactivation of your Account to allow you the option to reactivate it. After 30 days, your Account and all Personal Information will be deleted (subject to any legal requirement for us to retain these records). We may continue to store anonymized General Usage Data indefinitely. Any publicly accessible User Content, such as your submissions, Listings, and comments, may remain on the Website after your Account is deleted to maintain the functioning of the Website and the Service for all Users.
  5. You can disable cookies or otherwise manage them through tools provided with your browser software and with third party software packages. If you turn off cookies, many of the Website’s features will not work as well or at all.

6. CHILDREN’S ONLINE PRIVACY PROTECTION

  1. Buyertise understands the importance of protecting children’s privacy online. We do not knowingly collect, use, disclose or store personal information of children under eighteen (18) years of age. The Website and the Service is intended for adult users over eighteen (18) years of age.
  2. If it comes to our attention that a User is under eighteen (18) years of age, we will remove from our files all personally identifiable registration information about that User.

7. CHANGES TO THIS PRIVACY POLICY

  1. We may amend this Privacy Policy from time to time as we add new products and services, improve our current offerings, as technologies change, and/or to reflect legislative changes. Any change will be reflected at https://www.buyertise.com/privacypolicy, with the date of the most last modification displayed at the top of the Privacy Policy.
  2. We encourage you to check back periodically to see if we have made any changes. If we make any material or substantive changes in this Privacy Policy, we will notify you by posting a clear and conspicuous notice of these changes on the Website and in this Privacy Policy.

8. MISCELLANEOUS

  1. This Privacy Policy and the Service provided by Buyertise shall be governed by the laws of the province of Alberta. The parties hereby consent to the exclusive jurisdiction and venue of the Provincial and Queen’s Bench Courts of Alberta. If any provision of This Privacy Policy is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of This Privacy Policy, which shall remain in full force and effect.
  2. This Privacy Policy shall be binding upon and shall inure to the benefit of the parties and their respective heirs, executors, successors and permitted assigns. The rights under This Privacy Policy or any license granted hereunder may not be assigned, sublicensed or otherwise transferred by the User without the prior written consent of Buyertise, which retains the right to withhold consent in its sole discretion.
  3. All notices to Buyertise must be in writing and must be sent registered mail, certified mail, overnight mail or email.
